HIV/AIDS Waiver
What makes someone eligible for the HIV/AIDS Waiver?
The HIV/AIDS Waiver provides services in the community for individuals who have a HIV/AIDS diagnosis and are experiencing medical and functional symptoms associated with HIV/AIDS that would normally require care in a hospital or nursing home. To meet the requirement for hospital care, individuals must have had an inpatient hospital admission within three (3) months of the request for waiver services.
As with all Medicaid-funded services, there are also financial eligibility criteria.
Services offered through the HIV/AIDS Waiver
- Agency and Consumer-Directed Personal Assistance
- Private Duty Nursing
- Agency and Consumer-Directed Respite Care
- Case Management
- Enteral Nutrition
- Transition Services
- Personal Emergency Response System (PERS)
- For individuals participating in the Money Follows the Person project, environmental modifications and assistive technology for 12 months following a move to the community from a hospital or nursing home
If you answer yes to any/all of the following questions, you may be eligible for the HIV/AIDS Waiver.
- Have you been diagnosed with HIV/AIDS?
- Do you have medical needs as a result of your HIV/AIDS?
- Do you have symptoms that make it difficult to take care of yourself?
- Have you been admitted to a nursing home or hospital for an HIV/AIDS related illness in the past three months?

If you think that you might qualify for the HIV/AIDS Waiver, contact your local department of social services or local health department. To find information on-line, visit the VirginiaNavigator website, select “Departments of Social Services” or “Health Department,” and put in your zip code. After you contact your local department, a nurse and social worker will schedule a time to meet with you, assess your needs, and determine whether you are financially eligible. If you are in the hospital, a discharge planner may also do this. To see the assessment instrument that will be used (the Uniform Assessment Instrument or “UAI”), look on-line at the Department of Medical Assistance Services.
